These Terms & Conditions govern purchases made through the Would You Ever website and your use of the website. Would You Ever is operated by Would You Ever Brand, S.L. By placing an order, you agree to these Terms & Conditions together with our Shipping & Returns Policy and Privacy Policy.

1. About Us

Would You Ever Brand, S.L., NIF B26997643, has its registered office at C/ RUBEN MARICHAL LOPEZ, 16, 38004 Santa Cruz de Tenerife, Spain and is registered with the Mercantile Registry of Santa Cruz de Tenerife, Section 8, Sheet TF 77067, Entry 1. Customer support: help@wouldyouever.co.

2. Scope and Updates

These Terms apply to online purchases made through our website. We may update them from time to time for future use of the website and future orders. Changes will not retroactively alter an order that has already been accepted, except where required by law. Mandatory consumer rights always prevail where they provide you with greater protection.

3. How the Online Contract Works

To place an order, select your products, add them to your basket, provide the requested delivery and billing information, select the available shipping and payment options, review the order and submit it using the final order button. Before submitting the order, you can review and correct information entered during checkout.

The contract may be concluded in Spanish or English, and in any additional language expressly made available in the checkout. We electronically store order records for legal and operational purposes. They may not remain permanently accessible through the website, so we recommend keeping the confirmation emails and these Terms.

After you submit an order, we will send an electronic acknowledgement to the email address provided, normally immediately and in any event within the period required by applicable law. An automated acknowledgement confirms receipt of the order but does not necessarily mean that we have accepted it. Unless we expressly state otherwise, the sales contract is formed when we confirm dispatch of the order. If we cannot accept an order, any amount already collected for products we will not supply will be refunded.

4. Products and Availability

We take reasonable care to describe and display our products accurately. Product colours and appearance may vary slightly depending on your screen, lighting and the characteristics of the material or production process. Where a product includes garment-dye, wash, distressed, artisanal or similar finishing, minor variations may form part of the intended character of the product.

All products are subject to availability. If an item becomes unavailable after you place an order, we will contact you and, where appropriate, cancel the affected item and refund the amount paid for it.

5. Prices, Taxes and Currency

Prices are displayed in the currency available for your market. Before you submit your order, checkout will show the product price, applicable taxes collected by us, shipping charges and any other amount payable to Would You Ever. Your bank or payment provider may apply currency-conversion fees or use its own exchange rate, for which we are not responsible.

6. Payment

Payments are processed through secure third-party payment providers. The payment methods available for your market are shown at checkout. We may carry out or rely on standard payment and fraud-prevention checks. An order will not be dispatched unless payment has been successfully authorised or otherwise confirmed.

7. Discount Codes and Promotions

Unless the specific promotion states otherwise, discount codes:

  • Must be entered at checkout and cannot normally be applied after an order has been placed.

  • Cannot be combined with other codes or promotions unless expressly stated.

  • May be limited to selected products, collections, markets, customers, minimum spend or dates.

  • Have no cash value and may be withdrawn, cancelled or refused where used fraudulently, unlawfully or contrary to the promotion terms.

8. Shipping and Delivery

We ship to the destinations, at the rates and subject to the free-shipping thresholds set out in our Shipping & Returns Policy. Preparation and transit times are estimates unless expressly stated otherwise. Delays may occur because of carriers, customs, peak trading periods, public holidays or events outside our reasonable control. You are responsible for providing a complete and accurate delivery address and contact details.

For consumer orders, risk of loss or damage passes to you when you, or a third party designated by you other than the carrier, takes physical possession of the goods, except where applicable law provides otherwise.

9. International Orders, Customs and Import Charges

Orders delivered outside the relevant domestic tax or customs area - including the Canary Islands, the United Kingdom and countries outside the European Union where applicable - may be subject to customs clearance, import duties, local taxes, brokerage or other destination charges. Unless checkout expressly states that such charges are included, they are the responsibility of the customer and may be collected by the carrier or local authorities. Customs procedures may also affect delivery times.

10. Withdrawal, Returns and Refunds

If you are a consumer with a statutory right to withdraw from an online purchase, you may notify us of your decision to return eligible goods within 14 calendar days from the day you, or a person designated by you other than the carrier, receives the goods. After notifying us, you must send the goods back without undue delay and, in any event, within the following 14 calendar days.

For ordinary change-of-mind returns, the direct cost of return shipping is the responsibility of the customer and will be handled as described in our Shipping & Returns Policy. Returned items should be in their original condition, with the original tags attached, unworn other than as reasonably necessary to assess fit, unwashed, unaltered and free from stains, odours or damage. The original protective bag should be included where reasonably possible.

If handling goes beyond what is reasonably necessary to inspect the product and causes a reduction in value, we may make a deduction from the refund where permitted by law. Certain sealed goods that are not suitable for return for health-protection or hygiene reasons may be excluded from the statutory withdrawal right once unsealed, where legally permitted and clearly applicable to the product.

Where the statutory right of withdrawal applies, the refund includes the standard delivery charge originally paid, but not any additional amount resulting from a more expensive delivery method chosen by you. We may withhold the refund until we have received the returned goods or you provide valid evidence of having sent them back, whichever occurs first. 11. Faulty, Incorrect or Non-Conforming Items

If you receive an incorrect item or believe a product is faulty or does not conform to the contract, contact help@wouldyouever.co with your order number and relevant details before returning it. Where a product is legally non-conforming, the remedies and necessary shipping or transport costs will be handled in accordance with applicable consumer law. For consumers protected by Spanish law, the statutory period of responsibility for lack of conformity of new goods is three years from delivery. Mandatory remedies for non-conforming goods are provided without charge where required by law.

12. Order Refusal and Cancellation by Us

We may refuse or cancel an order before acceptance where reasonably necessary, including where a product is unavailable, payment is not authorised, information provided is materially incorrect, there is an obvious pricing or description error, we reasonably suspect fraud or misuse, or we cannot lawfully deliver to the requested destination. If we cancel an order after taking payment, we will refund the amount collected for products we do not supply.

13. Intellectual Property

All content made available through the website - including trademarks, logos, graphics, photographs, product imagery, designs, text, videos, layout and branding - is owned by or licensed to Would You Ever and is protected by intellectual-property laws. You may not reproduce, distribute, modify, publish, commercially exploit or otherwise use this content without prior written permission, except as permitted by law.

14. Acceptable Website Use

You must not use the website unlawfully, attempt to gain unauthorised access to our systems, interfere with website security or operation, introduce malicious code, misuse website content, or submit fraudulent, false or misleading information.

15. Liability

Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded or limited, or restricts mandatory consumer rights. To the extent permitted by law, we are not responsible for losses that are not reasonably foreseeable, business losses suffered by a consumer, or delays and failures caused by events outside our reasonable control. Minor variations in colour, texture or appearance that are inherent in materials, screens or disclosed production processes are not, by themselves, defects.

16. Events Outside Our Control

We will not be responsible for a failure or delay in performing obligations caused by circumstances beyond our reasonable control, including carrier disruption, customs delays, natural events, industrial action, transport interruption, network outages or government action. This does not affect any mandatory right you may have if performance becomes impossible or excessively delayed.

18. Governing Law and Consumer Rights

These Terms are governed by Spanish law, without depriving consumers of mandatory protections that apply under the law of their country of habitual residence. Any dispute will be submitted to the courts determined by applicable mandatory law. If you are acting as a consumer, nothing in this clause limits any right you may have to bring a claim before the competent courts available to you under consumer law.
